(三）质量保证金的适用范围：

1. 旅行社违反旅游合同约定，侵害旅游者合法权益，经旅游行政管理部门查证属实的；
2. 旅行社因解散、破产或者其他原因造成旅游者预交旅游

损失的。请求质量保证金赔偿的实时效期限为90天，从赔偿请求人受侵害事实发生时计算。
