在国务院的《营业性演出管理条例》中第九条规定，以从事营业性演出为职业的个体演员(以下简称个体演员)，应当依法到工商行政管理部门办理注册登记，领取营业执照自领取营业执照之日起20日内向所在地县级人民政府文化主管部门备案。

在《实施细则》中，这一条具体变为了：个体演员可以持个人身份证明和本实施细则第七条第二款规定的艺术表演能力证明，向户籍所在地或者常驻地县级文化主管部门申请备案。
