网络小贷牌照重启不会太快 需等待上位法出炉

各级小贷公司监管部门暂停批设网络小贷并开展网络小贷业务专项整治工作。

日前互金专项整治办下发的“175号文”曝光，其中在“正常运营机构”的工作指引中明确指出，“积极引导部分机构转型为网络小贷公司、主贷机构或为持牌资产管理机构导流等。”这是否意味着网络小贷牌照即将开闸，引发市场联想。but，小贷业内人士普遍认为，今年网络小贷牌照重启恐怕无望，这还需要等待上位法率先出炉。

作为上位法的《非存款类房贷组织管理条例》新修订版目前还未出炉，可能在一些条款上仍存争议。如果这部新修订的法案能够在今年上半年出炉的话，那么在此之后，监管部门还应在出台下位法《小贷公司管理条例》，此后才是各地的具体方案以及对网络小贷这个细分领域的具体实施细则。

当下网贷P2P机构仍在风险出清，远未到备案阶段。P2P和小贷公司这两个行业必须都得整顿结束之后，才有可能重新进行审批。

尽管网络小贷牌照已经被叫停，但行业各种乱象并未就此结束，有关现金贷的高l利l贷、砍l头l息、暴l力l催l收、变相现金贷等问题仍不断爆出，并且截至目前监管层尚未出台统一的网络小贷监管政策，行业仍存在监管套利空间。

可见目前整个行业亟需监管层出台统一的监管政策，来遏制网络小贷的混乱无序行为，引导行业健康可持续发展。必须现有针对小贷公司的统一规则，才能开闸网络小贷的审批流程，不会只因为网贷P2P机构需要转型就重启。在有统一规则之后，符合相关条件的机构才可以选择转型。
