对于境外再投资的事前分类监管，与9号令相同的是，11号令下境内企业以提供融资、担保方式通过其控制或参股的境外企业开展境外再投资，需要事前履行发改委核准（敏感类项目）或备案（非敏感类项目）手续，但境内企业不提供融资、担保通过其参股的境外企业开展境外再投资，不被纳入监管、无需履行事前核准备案或报告手续；与9号令所不同的是，11号令下境内企业不提供融资、担保通过其控制的境外企业（比如以自有资金）开展的境外再投资被纳入监管，但事前监管方式稍有不同，即需要事前履行发改委核准（敏感类项目）或向发改委报告（大额非敏感类项目，大额指中方投资额3亿美元及以上；3亿美元以下的非敏感类项目则无需备案或事前报告）。
