Materials required
- 法定代表人签署的《企业法人变更登记申请书》（企业加盖公章）；
- 《指定代表或者共同委托代理人的证明》（企业加盖公章）及指定代表或委托代理人的身份证复印件（本人签字）；Specific entrusted matters should be indicated、Authorization of the delegate、Entrustment period。
- 《公司（企业）法定代表人登记表》（本人签字，企业加盖公章）；
- 主管部门（出资人）根据企业章程的规定和程序出具的原任法定代表人的免职证明、新任法定代表人的任职证明；任职证明应依照企业章程的规定明确任命职务；章程规定职务空缺、以副职代理法定代表人的，应在其任职证明中明确“章程规定职务空缺，由副职代理法定代表人”。
- law、行政法规和国务院决定规定变更法定代表人必须报经批准的，Submit relevant approval documents or copies of license certificates；
- 《企业法人营业执照》副本。Note：依照《企业法人登记管理条例》设立的企业法人申请法定代表人变更登记适用本规范。

Change process
- 带齐资料到公司注册地所管辖的工商部门办理执照变更，It will take 5-10 working days after acceptance to receive the license of the new legal representative.
- 带齐资料到质量监督管理局办理企业组织机构代码证变更，Received after 2-3 working days after acceptance
- 到税务部门变更登记证，这里涉及到一个股权转让的个人所得税的问题，需要向地税部门申报和缴纳所得到股权的股东的个人所得税，还有必须出具新股东和法人的新验资报告。
- 最后变更公司基本户，Change the corporate seal and company information reserved in the bank。 变更法人所需材料：
- Original copy of business license;
- 新旧法人身份证复印件;
- official seal;
- A resume of the new legal entity、and the signature of the new legal person;
- Original Articles of Association;一般情况下变更法人只需要两周的时间即可办理完毕，一周跟工商局预约，再一周正式办理。
