必须是要有实际的公司注册地址，但是在顺应大众创新，万众创业的局势下，中国已经开始在公司注册地址方面放松了。
内资公司就是投资方为中国大陆国籍的人或是投资的企业再投为内资企业，反之为外资企业或合资企业；在我国有以下几种形式是合法的：有限责任公司、股份制公司、集团公司和个人独资企业。成立内资公司主要要注意的就是注册地址的选择，注册地址的选择成为现在注册公司的一个难题。
需要注意以下几点：（一）申请登记为企业住所（经营场所）的房屋应是取得权属登记的合法建筑，登记时应向登记机关提交《房屋所有权证》复印件。（二）作为住所（经营场所）的房屋用途应当与房屋所有权证记载的用途一致。
对使用房屋所有权证记载用途为“工业、教育、医疗卫生、其他（涉外、宗教、监狱）”的房屋作为住所（经营场所）申请登记的，应向登记机关提交房屋产权人出具的确有配套服务需求的说明；对使用房屋的规划批准材料为2009年10月1日《北京市城乡规划条例》实施前取得，并且其房屋所有权证记载的用途为“交通、仓储、Business、金融、信息、科研、文化、娱乐、体育、office、综合”的，在不改变产权权属的情况下，可作为住所（经营场所）办理登记注册。
（三）使用未取得房屋所有权证、特殊房产、住宅及境外机构和个人购买的房屋作为住所（经营场所）的，应当按下列情况提交相关文件证明。
