未经批准举办营业性演出的，由县级人民政府文化主管部门责令停止演出，没收违法所得，并处违法所得8倍以上10倍以下的罚款；没有违法所得或者违法所得不足1万元的，并处5万元以上10万元以下的罚款；情节严重的，由原发证机关吊销营业性演出许可证。
