保安从业单位有下列情形之一的，责令限期改正，给予警告；情节严重的，并处1万元以上5万元以下的罚款；有违法所得的，没收违法所得：

1. 保安服务公司法定代表人变更未经公安审核的；
2. 未按照本条例的规定进行备案或者撤销备案的；
3. 自行招用保安员的单位在本单位以外或者物业管理区域以外开展保安服务的；
4. 招用不符合本条例规定条件的人员担任保安员的；
5. 保安服务公司未对客户单位

1. 保安服务公司未按照本条例的规定签订、留存保安服务合同的；

客户单位未按照本条例的规定留存保安服务中形成的监控影像资料、报警记录的，依照前款规定处罚。

保安员不得有下列行为：

1. 限制他人人身自由、搜查他人身体或者侮辱、殴打他人；
2. 扣押、没收他人证件、财物；
3. 阻碍依法执行公务；
4. 参与追索债务、采用或者以相威胁的手段处置纠纷；
5. 删改或者扩散保安服务中形成的监控影像资料、报警记录；
6. 侵犯个人隐私或者泄露在保安服务中获知的国家秘密、商业秘密以及客户单位明确

保安服务公司派出保安员跨省、自治区、直辖市为客户单位提供保安服务的，应当向服务所在地设区的市级公安备案。备案应当提供保安服务公司的保安服务许可证和工商营业执照、保安服务合同、服务项目负责人和保安员的基本情况。
