文化部修改的《互联网文化管理暂行规定》中，互联网文化产品、互联网文化活动以及互联网文化的单位做出了一下规定，in：“互联网文化产品”是指通过互联网生产、传播和流通的文化产品，主要包括：1、网络音乐娱乐、游戏、网络演出剧目、网络表演、网络艺术品、网络动漫等一系列互联网文化产品；2、通过技术手段制作，复制音乐娱乐、游戏、演出剧（节）目、表演、艺术品、动漫等文化产品，然后传播到互联网上的网络文化产品。
“互联网文化活动”是指提供互联网文化产品及其服务的活动，主要包括：1、网络文化产品的制作，发行，发行，进口，播放等活动；2、通过互联网将文化产品登载，以及通过互联网，移动通信网的信息网络发部带计算机，移动产品，电视机，游戏机，等供用户浏览，使用，欣赏，或下载等行为;3、互联网文化产品的展览、比赛等活动。
所谓的“互联网文化单位”是指经文化部门和电信管理机构批准或者备案，从事互联网文化活动的互联网信息服务提供者，从事互联网文化活动的单位/公司须取得许可证合法经营。申请网络文化经营许可证通过后，省级文化行政部门应在本部门网站对同意设立的网络文化经营单位进行公示。
