食品经营许可证到期未延续构成无证经营 个体食品经营户陈某因疏忽大意，在食品经营许可证5年有效期届满后未及时申请延续。基层执法人员认为陈某的行为违法，拟定性为无证经营食品违法行为。案件进入核审阶段后，法制机构提出不同意见。

one、许可证到期未延续不构成无证经营 食品经营许可属于《行政许可法》规定的有期限的行政许可。现行法律规范仅对许可证到期后如何办理延续以及不再经营的注销等程序作出规定。《食品经营许可管理办法》第十九条规定，食品经营许可证发证日期为许可决定作出的日期，有效期为5年。

《食品经营许可管理办法》第二十九条规定，食品经营者需要延续依法取得的食品经营许可的有效期的，应当在该食品经营许可有效期届满30个工作日前，向原发证的食品药品监督管理部门提出申请。

three、必须依法注销的要严格履行法定程序 《食品经营许可管理办法》将注销分为主动申请注销（第三十六条）和监管部门依法注销（第三十七条）两种情形。

虽然《行政许可法》对注销行为未作出具体程序规定，但《食品经营许可管理办法》第三十八条作出了原则性规定：“食品经营许可证变更、延续、补办与注销的有关程序参照本办法第二章和第三章的有关规定执行。

”依职权作出注销决定的，应向经营者进行书面告知，并说明理由，同时告知经营者依法享有申请行政复议或者提起行政诉讼的权利。
