〔许可机关及其工作人员法律责任〕 人力资源社会保障行政部门及其工作人员有下列情形之一的，依法给予行政处分；构成犯罪的，依法追究刑事责任：

1. 向不符合法定条件的申请人发放《劳务派遣经营许可证》，或者超越法定职权发放《劳务派遣经营许可证》的；
2. 对符合法定条件的申请人不予行政许可或者不在法定期限内作出准予行政许可决定的；
