根据《人力资源和社会保障》第19号令的规定，凡有下列情况之一的劳务派遣公司可依法申请注销：
- 由于劳务派遣许可证已到期，在逾期还未申请延续的或延续申请未被批准的申请公司可申请注销。
- 由于劳务派遣公司的经营不善导致的破产可依法申请注销。
- 由于已获得劳务派遣经营许可证的公司在经营过程中有违法行为或是年检时不合格导致被吊销许可证的。
- 劳务派遣公司违法其他法条法规等情况。劳务派遣公司想注销许可证的需填写《劳务派遣行政许可注销申请书》并将公司的年检资料、经营情况报告等资料提交给许可机构进行审核。
