关于申报境外投资备案发改委审批法律责任问题：1、关于项目申请报告内容失实的法律责任根据《管理办法》第二十八条的规定，投资主体应当对境外投资项目申请报告或项目备案申请表及附件的真实性、合法性负责。

投资主体在境外投资项目申报过程中违反法律法规，隐瞒有关情况或提供虚假材料的，国家发展改革委员会将不予受理或不予核准、备案;已经取得核准文件或备案通知书的，国家发展改革委员会将撤销核准文件或备案通知书，并给予警告。

2. 关于未依法报送项目信息而开展实质工作的法律责任对于投资主体应报送项目信息报告但未获得信息报告确认函而对外开展实质性工作的，国家发展改革委员会将予以通报批评，责令其纠正。
