商标基础简介，分清TM商标和R商标商标的定义是这样的，用于区别其他服务和商品的标志。关于商标的组成，我国《商标法》规定：“任何能够将自然人、法人或者其他组织的商品与他人的商品区别开的标志，包括文字、图形、字母、数字、三维标志、颜色组合和声音等，以及上述要素的组合，均可以作为商标申请注册。

因为商标本身有已注册和未注册之分，所以就有了TM商标和R标志的区别，TM标志的商标是未注册或是提交了注册申请正在审核，R标志则是已经注册了，在商标局能够查的出来的商标已注册的R商标受到商标法的保护。很多人会觉得，既然受法律保护的是R商标，那么把TM标识用到自己的产品或服务上有什么意义？

既然没有注册，为什么还要拿出来用？事情是这样的，一般公司在使用TM商标时，都是已经申请了该商标的，只不过商标注册的时间太长，一般在一年以上，so，很多公司都会用TM标识，表明自己已经注册了，让其他人不要再来注册。

商标注册是有优先申请权的，先申请的那个会优先注册，其他（同类目下）近似或一样的会被驳回，so，建议商标注册越早越好。既然先申请先得，那么我是不是可以先使用R标识的商标呢？

不可以使用R标识的商标必须是已经注册的商标，即便你的TM商标再过几个月就能变成R商标了，也不能先用R标识，只能用TM，否则就属于冒用注册商标是违反商标法的。
