：设立经营人身保险业务的外资保险公司和经营财产保险业务的外资保险公司，其设立形式、外资比例由中国保监会按照有关规定确定。
合资保险公司、独资保险公司的注册资本最低限额为2亿元人民币或者其等值的自由兑换货币；其注册资本最低限额必须为实缴货币资本。外国保险公司的出资，应当为自由兑换货币。外国保险公司分公司应当由其总公司无偿拨给不少于2亿元人民币等值的自由兑换货币的营运资金。
中国保监会根据外资保险公司业务范围、经营规模，可以提高前两款规定的外资保险公司注册资本或者营运资金的最低限额。
申请设立外资保险公司的外国保险公司，应当具备下列条件：经营保险业务30年以上；在中国境内已经设立代表机构2年以上；提出设立申请前1年年末总资产不少于50亿美元；所在国家或者地区有完善的保险监管制度，并且该外国保险公司已经受到所在国家或者地区有关主管当局的有效监管；符合所在国家或者地区偿付能力标准；所在国家或者地区有关主管当局同意其申请。
