- 一百万元以上的注册资本，有自己的名称、组织机构和章程；
- 有符合有关法律、行政法规及本办法规定的拍卖业务规则以及规划；
- 要有固定的办公经营场地，至少三名取得拍卖业从业资格的人员，包含一名拍卖师，且是与主营业务联系密切的专职或兼职人员。
two、办理拍卖经营许可证所需材料：
- 公司所在房产的正复印件或租房合同原件；
- 拍卖师的正书原件、职业记录、单位变更审批表；
- 拍卖师提供一年三次以上，三年九场以上的拍卖证明、有公章的拍卖笔录和拍卖成交确认书；
- 拍卖员的的从业原件；
- 公司法人以及股东的身份证原件；
- 法人简历和照片；
- 人名章(所有法人和股东的人名章都要)；
- 公司名称核准通知书；
- 企业法人的手机号、座机号和邮箱号。
其中如果是文物拍卖需要五个以上的拍卖专家及拍卖师拍卖员。
