生产、储存、使用危险化学品的单位转产、停产、停业或者解散，未采取有效措施及时、妥善处置其危险化学品生产装置、储存设施以及库存的危险化学品，或者丢弃危险化学品的，由安监部门责令改正，处5万元以上10万元以下的罚款;构成犯罪的，依法追究刑事责任。

生产、储存、使用危险化学品的单位转产、停产、停业或者解散，未依照本条例规定将其危险化学品生产装置、储存设施以及库存危险化学品的处置方案报有关部门备案的，分别由有关部门责令改正，可以处1万元以下的罚款;拒不改正的，处1万元以上5万元以下的罚款。

危险化学品经营企业向未经许可违法从事危险化学品生产、经营活动的企业采购危险化学品的，由工商行政部门责令改正，处10万元以上20万元以下的罚款;拒不改正的，责令停业整顿直至由原发证机关吊销其危险化学品经营许可证，并由工商行政部门责令其办理经营范围变更登记或者吊销其营业执照。
