根据条例第30(3)strip，关长仅可在信纳有以下的情况，才向申请人批给经营金钱服务的牌照或将其所持牌照续期— (a)如该申请人属个人，the individual and each ultimate owner are fit and proper persons to operate the money service； (b)如该申请人属合夥，该合夥的每名合夥人及每名终拥有人均属经营金钱服务的适当人选； (c)如该申请人属法团，Each director and each ultimate owner of the corporation is a fit and proper person in connection with the conduct of a money services business。
4.3甚麽是终拥有人？ 4.3.1就牌照申请人或持牌人属个人而言，终拥有人是一 (a)指终拥有或控制该名个人的金钱服务业务的另一名个人；or (b)如首述个人是代表另一人行事，指该另一人。
4.3.2就牌照申请人或持牌人属合夥而言，终拥有人是一 (a)直接或间接地有权摊分或控制该合夥的资本或利润的25%以上; (b)直接或间接地有权行使在该合夥的投票权的25%以上，或支配该比重的投票权的行使；or (c)行使对该合夥的管理终的控制权。
4.3.3就牌照申请人或持牌人属法团而言，终拥有人是一 (a)直接或间接地拥有或控制(包括透过信托或持票人股份持有)该法团已发行股本的25%以上； (b)直接或间接地有权行使在该法团的成员大会上的投票权的25%以上，或支配该比重的投票权的行使；or (c)可行使对该法团的管理终的控制权。
4.4适当人选是甚麽意思？
关长在断定某人是否适当人选时，The following factors must be taken into account: (a)whether the person has ever been convicted of a crime (i)本条例第5(5)、(6)、(7)or(8)、10(1)、(3)、(5)、(6)、(7)or(8)、13(1)、(3)、(5)、(6)、(7)or(8)、17(9)、20(1)、61(2)或66(3)Offenses under Article； (ii)《联合国(反恐怖主义措施)条例》(第575章)第14(1)Offenses under Article； (iii)《贩毒(追讨得益)条例》(第405章)第25(1)、25A(5)or(7)条所 订罪行，或附表1指明的罪行；or(iv)《有组织及严重罪行条例》(第455章)第25(1)、25A(5)或8条所订罪行，或附表1或2指明的罪行； (b)该人是否曾在香港以外地方被裁定— (i)就某作为犯了某罪行，而该作为假若是在香港作出，即会构成(a)(i)、(ii)、(iii)or(iv)指明的罪行； (ii)犯关乎洗钱或恐怖分子资金筹集的罪行；or (iii)犯任何罪行，而该人曾有欺诈性、舞弊或不诚实的作为的裁断对该项定罪属必不可少； (c)该人是否屡次不遵从根据本条例施加的

或关长根据第51条订立的任何规例； (d)(如该人属个人)该人是否未获解除破产的破产人或《破产条例》(第6章)下的破产程序的标的； (e)(如该人属法团)Is the person in the process of liquidation?，or whether the subject of any winding up order，or whether a receiver has been appointed in respect of that person。
