3. 两个以上企业共同开展境外投资的，The relatively large shareholder shall complete the filing or apply for approval after seeking the written consent of other investors.。

如果各方持股比例相等，应当协商后由一方办理备案或申请核准。如投资方不属同一行政区域，负责办理备案或核准的商务部或省级商务主管部门应当将备案或核准结果告知其他投资方所在地商务主管部门。
