- 营业执照由国家工商行政管理局统一制定，由各级工商行政管理机关按照管辖权颁发，除工商行政管理部门外，任何单位和个人无权颁发、复制、收缴、扣拥，更不得伪造、毁坏和涂改，否则要依法追究责任。
